Rich Mallory concentrates his practice on community association matters and also represents clients in commercial litigation.  As outside counsel for small and large community associations in Virginia and D.C., Rich consistently advises clients on topics such as:

  • Drafting and amending governing documents
  • Calling and conducting required meetings
  • Reviewing and executing vendor contracts
  • Interacting with state and local government authorities
  • Pursuing and collecting assessment and violations dues owed
  • Filing and litigating controversies seeking equitable relief
  • Interfacing and negotiating with adverse parties’ attorneys for mutually acceptable outcomes

Rich takes pride in providing community associations with swift and clear answers to questions regarding how the law affects the decisions community associations make in the course of their operations.  Arming community associations with information is how Rich helps community associations to keep their budgets under control and their property values high.  For instance, Rich recognized that a reality television company that was seeking to shoot an episode in a client’s development produced one of the highest rated programs on a major cable channel, reaching over 1.5 million viewers a week.  By quickly reviewing and approving the contract Rich was able to inform management and the community association’s board of directors that not only were the contract terms favorable and enforceable but that the program would expose the property owners’ association to a great number of potential buyers.
Rich also vigorously advocates for clients’ rights in adversarial proceedings in a variety of jurisdictions and venues.  In cases that range from simple breach of contract for delinquent assessments to injunctions against neighbors who refuse to maintain their property, Rich litigates in an efficient manner that gets results.
