Federal, state and local laws that govern employment (including minimum wage, overtime laws, family medical leave laws, disability compliance, discrimination laws and employee health and safety matters) are complex and ever-changing. Our experience can be invaluable in helping our clients avoid the expensive and distracting problems that arise every day in handling personal issues.

Rees Broome attorneys regularly counsel clients regarding employment law matters such as employment contracts, severance agreements, non-compete agreements, restrictive covenants, employment manuals and policies and EEO matters. Our attorneys have substantial experience defending clients from charges of discrimination filed with the courts, the Equal Employment Opportunity Commission, and state and local agencies.

We believe that an ongoing dialogue with our clients is essential to delivering effective results to our clients. Joel M. Birken
Over his thirty-five years in the legal profession, Joel Birken has been repeatedly selected as one of the “Best Lawyers in America” in the specialty of Corporate Law (most recently Best Lawyers, 2011). His practice focuses primarily on small privately-held businesses and professional practices, from formation through merger, recapitalization, sale or dissolution. He has extensive experience advising executives and owners of professional practices in employment contracts, non-compete agreements and ownership rights.

Susan R. Salen

Susan Salen has an unusual legal background that combines litigation, corporate transactions and employment law, giving her an exceptional understanding of how to successfully structure business agreements, work through personnel matters and provide clients with practical solutions for day-to-day business problems.

Susan has represented private business such as: professional services companies (including medical practices, engineering practices and architectural practices), technology companies, staffing companies, construction companies and community associations in a broad range of employment matters.  Susan provides advice and direction in the development of effective hiring practices, policies, employment manuals, and answering day-to-day operational HR questions.  When needed, Susan helps her business clients in responding to unemployment compensation claims and in hearings, defending unlawful discrimination claims and wrongful termination suits, and wage and hour claims and disputes.  Susan strongly believes in an interactive approach to resolving personnel issues in which the views of HR personnel and/or business owners are essential to finding the right solution.

For individuals, Ms. Salen assists executive level employees in the negotiation of employment agreements at the commencement of employment and negotiation of severance agreements and packages upon termination of employment.  Ms. Salen counsels executives regarding non-compete obligations and other post-employment obligations. 

For more than twenty-five years, through effective communication, dialogue and understanding a client’s need to run a business while still remaining compliant with the myriad of employment laws, Ms. Salen’s goal is to ensure that her clients are in the best position possible to avoid claims and when claims are filed to defend against such claims.

Representative Experience
•  Assist clients in resolution of Department of Labor Wage and Hour Division audits, in which representation teaching clients how to comply with applicable wage and hour laws to avoid future claims is an important component.
•  Represents clients in defense of discrimination claims filed with the Equal Employment Opportunity Commission and local equal employment opportunity agencies, often obtaining dismissal of such claims by the applicable agency by providing a comprehensive and persuasive response to request for information and position statements.
•  Assists clients in navigating Office of Federal Contract Compliance Programs desk audits and on-site inspections.
•  Routinely advises and works with clients to ensure compliance with and to avoid issues arising under federal, state, and local employment and anti-discrimination laws, including the Americans With Disabilities Act, Age Discrimination in Employment Act
• Routinely advises and works with clients with respect to compliance with federal wage and hour laws: Fair Labor Standards Act, Davis Bacon Act and Service Contract Act, and wage and hour laws in Virginia, Maryland and the District of Columbia
•Help clients with difficult terminations, from analyzing when to terminate to employment, to effectuating the termination and responding to any unemployment or other claims filed after such termination of employment
• Counsels business and executive on compensation, non-compete, ownership and severance arrangements
• Counsels business regarding the proper classification of employee versus independent contractor

Susan is a frequent lecturer for National Business Institutes on employment matters and has presenting Continuing Legal Education programs for the Virginia State Bar on executive employment agreements and independent contractor agreements.

Maureen E. Carr
Maureen Carr represents individuals, businesses and community associations in cases involving a variety of employment disputes. Maureen also counsels and represents clients before courts and agencies which deal with employment matters including discrimination, retaliation, enforcement of employment agreements, FMLA, USERRA and wage and hour issues.

Andrew B. Golkow
Andy Golkow, who is an MBA/CPA as well as an attorney, has focused for more than twenty years on representing closely-held businesses and their owners. He has particular expertise in business formation and in corporate real estate transactions, including commercial leasing.

•  Represented client in the technical security field in connection with acquisition of their company by one of the largest consulting and information technology companies in the United States
•  Represented defense contractor producing defense and intelligence-oriented satellite and technical systems in acquisition by national company
