Creditors Rights and Bankruptcy

We principally represent lenders and trade creditors, assisting our clients in out-of-court workouts as well as business reorganizations in bankruptcy court. We frequently represent clients in the purchase and sale of assets by and from bankrupt estates. Our credit and bankruptcy attorneys work together with attorneys in our other practice areas, such as taxation, employment law and litigation, to provide comprehensive advice on all aspects of workouts and reorganizations.

Our bankruptcy group appears regularly in claims and adversary proceedings filed in the U.S. Bankruptcy Court and upon appeal to the U.S. District and Circuit Courts.

James M. Lewis
Jim Lewis has over 30 years’ experience representing secured and unsecured creditors (including lenders, landlords and franchisors), trustees, creditors’ committees, venture capitalists with distressed portfolio companies and debtors in Chapter 11 reorganizations and Chapter 7 liquidations.  He has served as a Chapter 7 panel trustee and has been certified since 1993 as a specialist in Business Bankruptcy by the American Board of Certification. (Virginia has no procedure for approving certifying organizations.)

Representative Experience

• Led acquisition team in foreign entity’s purchase of 175 gas stations/convenience stores with over 800 USTs in four jurisdictions for over $40 million in Sec. 363 sale.
• Represented interested bidder in Sec. 363 sale of assets/assignment of lease in Chapter 11 sale of helicopter manufacturer.
• Represented unsecured creditors committee as active local counsel in chapter 11 of telecommunication company resulting in a carve-out of funds for unsecured creditors as part of conversion of over $100 million in debt to equity.
• Represented trustees in sale of 50 plus restaurants and in sale of residential lots through curing of defaults on bonded public improvements.
• Regularly represents commercial landlords in large retail chapter 11, trade creditors in defense of preference actions, under-secured equipment lenders and banks with financially distressed borrowers.

Erik W. Fox
Erik Fox represents bankruptcy creditors and businesses undergoing Chapter 11 reorganization. Much of his experience is in the context of community and homeowners’ associations as creditors of owners who are facing or have declared bankruptcy.

Representative Experience

•  Ensures that creditor CA’s and HOA’s receive the maximum amounts recoverable once an owner/debtor declares bankruptcy
•  Ensures that creditor CA’s and HOA’s receive payment for assessments accruing while the debtor is in bankruptcy
